Payment and General Terms and Conditions of the Tourist Leasing Contract

PAYMENT - TOURIST PROPERTY RENTAL

The reservation will be considered confirmed upon receipt of a deposit equal to 30% of the total amount of the stay, which must be paid according to the methods described below. For reservations made less than 15 days before the start of the stay, the full amount must be paid.

The deposit can be paid directly by credit card at the time of booking on the website or by bank transfer (to be made within 3 days of the booking request date) to the bank account indicated below.
The balance of the stay must be paid by bank transfer at least 15 days before arrival. Any deposits, supplements, and/or additional costs that are specified in the description of each individual property must be paid upon arrival.

PLEASE NOTE: within 3 days of the booking date, a copy of the deposit payment must be sent to the following email address: silviabarbetti@elbaluxury.it. If, within 5 days of the booking date, we have not received the receipt confirming payment of the deposit in accordance with the above conditions, the booking will be automatically canceled. Upon receipt of the deposit, we will send a booking confirmation email, which must be presented upon arrival at the booked property.

PLEASE NOTE: Elbaluxury operates under a mandate contract for the management of tourist property rentals and therefore cannot issue guests with invoices for the cost of their stay. The owners of the properties listed on the website www.elbaluxury.it, if they are individuals without a VAT number, are not obliged to issue receipts (or invoices) for their non-commercial properties and tourist rentals, but, at the guest's request, they are required to provide a paper receipt (which can also be sent by email in pdf format).

GENERAL TERMS AND CONDITIONS OF THE TOURIST RENTAL AGREEMENT

1 - TRAVEL CONTRACT AND LIABILITY

The liability of ELBALUXURY (hereinafter referred to as the “Organizer”), by virtue of its power to lease the properties listed on the website www.elbaluxury.it, cannot in any case exceed the limits set by current regulations.

2 - RESERVATIONS

The acceptance of reservations is subject to availability and is only considered final, with the consequent conclusion of the contract, upon written confirmation by the Organizer, including by electronic means. The Organizer may issue a copy of the receipt to the consumer only if it is already in possession of the confirmation referred to in the previous paragraph. Any information relating to the reservation and not contained in the contractual documents, brochures, or other means of communication will be provided by the Organizer in good time before the start of the stay.

3 - DEPOSIT AND BALANCE

At the time of booking, a deposit equal to 30% of the total amount of the stay must be paid. The balance of the stay must be paid at least 15 days before arrival. For bookings made less than 15 days before the start of the stay, the full amount must be paid. More detailed information on payment methods can be found under “payment.”

4 - CONSUMER WITHDRAWAL

The consumer may withdraw from the contract without paying anything only when notified of a change to an essential element, in which case, if they exercise their right of withdrawal, they are entitled, alternatively, to use another holiday package or to be reimbursed for the part of the price already paid at the time of withdrawal. The vacation package that the consumer decides to take advantage of must be of an amount not less than that originally planned. If the Organizer or, on its behalf, the seller is unable to offer a package of equivalent or greater value, the consumer is entitled to a refund of the difference. Consumers who withdraw from the contract will be charged no more than the amounts indicated below as compensation for withdrawal. 
Stays in vacation homes, apartments, villas, and residences:
If the reservation is canceled within 60 days of the arrival date, the deposit will be refunded within 30 days of cancellation.
If the booking is canceled within 59 days of the arrival date, the deposit will not be refunded.
If the booking is canceled within 15 days of the arrival date, no refund will be given. 

5 - SUBSTITUTIONS

The customer who withdraws may be replaced by another person provided that:
a) the Organizer is informed in writing within 30 working days before the date set for departure, receiving at the same time communication about the details of the transferee;
b) there are no reasons relating to passports, visas, health certificates, accommodation chosen, transport services or otherwise such as to make it impossible for a person other than the customer who has withdrawn to use the package;
c) the transferee reimburses the Organizer for any expenses incurred in making the replacement, to the extent that these will be quantified at the time of notification of the transfer.
The customer will also be jointly and severally liable with the transferee for the payment of the balance of the price, as well as the amounts referred to in letter c) of this article.

6 - FAILURE TO PERFORM

The consumer may exercise the rights provided for in Article 5 above, even if, prior to departure, the Organizer, for any reason other than a fact attributable to the consumer, communicates the impossibility, for reasons beyond its control, of providing the services covered by the booking, provided that this is brought to its attention within the period prior to the start of the tourist services indicated by the Organizer. In this case, as in the case of withdrawal referred to in Article 4 above, the Organizer shall only be required to refund the sums received within 10 working days from the moment of withdrawal or cancellation, excluding any further expenditure.

7 - OBLIGATIONS OF PARTICIPANTS

Participants must be in possession of an individual passport or other valid document. They must also comply with the rules of normal prudence and diligence in relation to all information provided to them by the Organizer, as well as with the regulations and administrative or legislative provisions relating to the booking. Participants will be held liable for any damages that the Organizer may suffer as a result of their failure to comply with the above obligations. The consumer is required to provide the Organizer with all documents, information, and elements in their possession that are useful for the exercise of the latter's rights of subrogation against third parties responsible for the damage and is liable to the Organizer for any prejudice caused to the right of subrogation. The consumer shall also communicate in writing to the Organizer, at the time of booking, any specific requests that may be subject to specific agreements on the terms of the stay, provided that it is possible to implement them.

8 - CLASSIFICATION OF ACCOMMODATION

In the absence of official classifications recognized by the competent Italian public authorities to which the relevant service refers, the accommodation chosen for the stay is determined by the Organizer on the basis of its own criteria for assessing quality standards.

9 - ORGANIZER'S LIABILITY

The Organizer is liable for damages caused to the consumer due to total or partial failure to perform the services contractually due, whether these are performed by the Organizer personally or by third-party service providers, unless the Organizer can prove that the event was caused by the consumer (including initiatives taken independently by the latter during the performance of the services booked) or to circumstances unrelated to the provision of the services provided for in the contract, due to unforeseeable circumstances, force majeure, or circumstances that the Organizer could not reasonably foresee or resolve, according to professional diligence.

10 - OBLIGATION TO PROVIDE ASSISTANCE

The Organizer is required to provide assistance to the consumer in accordance with the criteria of professional diligence exclusively in relation to the obligations incumbent upon it by law or contract. The Organizer is not liable to the consumer for the seller's failure to fulfill its obligations.

11 - COMPLAINTS AND CLAIMS

The consumer must immediately report any discrepancies and defects in the booked stay, as well as any failures in its organization or implementation, to the Organizer in writing in the form of a complaint, at the time they occur or, if not immediately recognizable, within 10 days of the scheduled return date to the place of departure, under penalty of forfeiture. If complaints are made at the place where the tourist services are provided, the Organizer must provide the consumer with the assistance required by Article 10 above in order to find a prompt and fair solution. Similarly, the Organizer must also take action in the event of a complaint made at the end of the services, ensuring in any case a prompt response to the consumer's requests.

12 - INSURANCE AGAINST CANCELLATION COSTS

If not expressly included in the price, before departure it is possible, and indeed advisable, to take out special insurance policies for cancellation of the stay, accidents, and luggage. In the case of foreign citizens, it is also advisable to take out an assistance contract covering repatriation costs in the event of accidents and illness.

13 - PRIVACY

The consumer declares that they have received the information sheet pursuant to Article 13 of Legislative Decree No. 196 of June 30, 2003 (Personal Data Protection Code) and, having taken note of it, consents to the processing of their personal data.

14 - JURISDICTION

Any dispute arising from this contract shall be settled exclusively by the Court of Livorno. By mutual agreement, however, it may be agreed that disputes arising from the application, interpretation, or execution of the contract shall be referred to an Arbitration Board composed of as many arbitrators as there are parties to the dispute plus one who shall act as Chairman appointed by the arbitrators already designated or, failing that, by the President of the Court of Livorno. The Arbitration Board, which shall be based at the Organizer's registered office, shall decide in accordance with the law, after any attempt at conciliation.

FACILITIES USED

All the managers of the facilities published on this website have declared in their agreements with the Organizer that their services are suitable and, in the same agreements, have declared that they are duly authorized to carry out their activities.

The cost of a cot, if applicable, includes accommodation only.

DISTANCES

The distances given for each facility are to be considered approximate.

REGISTRATION FEES

There are no registration fees.

VALIDITY OF PROGRAMS AND RATES

The programs contained on this website are valid for the period indicated (if specified) or for the current year (if no period is indicated). Ship schedules, descriptions of facilities, itineraries, and excursions, as well as information on destinations, are provided by the Organizer based on the information in its possession at the time of writing the programs and are subject to change without notice.

DEPOSITS

If required, customers must pay a deposit equal to the amount indicated in the price list directly to the facility upon arrival. The amount will be refunded at the end of the stay after the property has been checked. In the event of damage, an amount equal to the damage caused will be retained.

PRICES AND DISCOUNTS

The prices of the apartments are per unit; where otherwise specified, please refer to the price lists of each property. The prices shown on this website are in euros and include VAT, where applicable.

BEDS

The maximum number of people allowed in the apartments is indicated in the description of each individual property.

LUGGAGE

Luggage travels at the customer's own risk and the Organizer cannot be held responsible for any loss or damage.

START OF STAY

The start and end dates of the stay are indicated in the description of each individual property. Any exceptions are granted only by the properties based on their organizational needs. As a rule, apartments are available for check-in from 4:00 p.m. to 7:00 p.m. on the day of arrival. Check-out is by 10:00 a.m. on the day of departure. Unless otherwise stated in the description of each individual property.

PRICES INCLUDE

Accommodation at the chosen property and the services booked and confirmed. VAT, if applicable, service charges, and all specifications listed in the offer are also included.
